Abstract
Political interference, corruption and inadequate funding have continued to challenge the Nigerian judiciary, whose independence and effectiveness are essential to the sustenance of democracy and the enforcement of the rule of law. This study examines how these challenges affect the judiciary’s capacity to uphold democratic values, protect fundamental rights and serve as a check on the exercise of governmental power. It adopts a qualitative research methodology involving interviews with legal experts, case study analysis and an examination of the Constitution of the Federal Republic of Nigeria 1999 and relevant legal frameworks. The literature review reveals a significant gap between the constitutional guarantees of judicial independence and their practical implementation. While some scholars acknowledge progress in strengthening judicial independence, others highlight concerns regarding the politicisation of judicial appointments and decision-making. The study further identifies inadequate funding, limited administrative autonomy and pressure from influential political actors and the executive as factors that constrain judicial effectiveness. It argues that without genuine judicial independence and improved institutional capacity, Nigeria’s democratic institutions remain vulnerable to the erosion of constitutional governance and the rule of law. The study concludes that urgent legal and institutional reforms are necessary to strengthen the judiciary. It recommends measures to guarantee financial autonomy, promote transparency and accountability in judicial appointments, and establish effective safeguards against external interference. Specific proposals include reviewing the framework for judicial appointments and discipline, introducing appropriate constitutional amendments to reinforce judicial independence, and increasing budgetary allocations to improve the judiciary’s operational capacity. These reforms are essential to enabling the Nigerian judiciary to function effectively as a check on governmental power and a guardian of democratic values.
