Abstract


The right of access to information is widely recognised as a fundamental human right and an essential component of democratic governance. Nigeria aligned itself with global democratic standards through the enactment of the Freedom of Information Act, 2011 (FOIA), which has been widely regarded as a landmark legislative development in the country’s effort to dismantle the culture of secrecy in governance and promote the ideals of transparency, accountability, and open government.

 

Adopting a doctrinal research methodology, this paper examines the provisions of the Act, relevant judicial decisions, and the opinions of learned scholars in order to evaluate the extent to which the FOIA has been implemented over the past fourteen years. The study further seeks to determine whether the Act remains fit for purpose in its current form or whether reforms and amendments are necessary to improve its effectiveness and practical implementation.

 

The paper argues that although the FOIA substantially reflects international best practices and global trends in freedom of information legislation, certain local peculiarities and institutional challenges continue to hinder effective access to information in Nigeria. These challenges include bureaucratic resistance, inadequate institutional capacity, poor record-keeping systems, limited technological infrastructure, and a persistent culture of official secrecy within public institutions.

 

Accordingly, the paper recommends targeted legislative amendments and institutional reforms aimed at strengthening the implementation of the Act. It also advocates increased investment in equipment and information technology infrastructure, improved record management systems, and a broader attitudinal shift among public officials toward transparency and accountability in order to enhance the effective enjoyment of the right to information in Nigeria.
