Abstract


The study examined the transformative influence of artificial intelligence (AI) on contract agreements. This paper explores how AI may affect conventional contracting procedures, emphasizing the opportunities and challenges associated with automated contracting. The analysis extends to the legal position of AI-generated contracts, their enforceability, and the treatment of subjective contractual obligations involving AI technologies. By surveying regulatory frameworks and ethical dimensions, the paper seeks to provide a comprehensive understanding of the dynamic interplay between AI and contract law. The paper further aims to compare the legal frameworks governing AI-generated agreements in jurisdictions such as the United States, South Africa, and England and Wales. In conclusion, the paper promotes a balanced approach that acknowledges the benefits of artificial intelligence in contracting while addressing the inherent difficulties and risks associated with its application.
