EMERGING TRENDS ON THE CONCEPT OF ENVIRONMENTAL JUSTICE AND GOVERNANCE IN NIGERIA

Abstract

This paper discussed environmental justice vis-à-vis the subject on social and practical step requiring fair treatment and involvement of all human irrespective of age, sex, color, creed, class or nationality. The research adopted the doctrinal approach to examine and the principles, treaties legal and regulatory framework on environmental justice and governance in Nigeria. The paper highlighted some of the relevant provisions on the concept of environmental justice and governance. It was found that the concept of environmental justice in Nigeria is impeded by factors such as the non-justiciability of environmental matters under the Nigerian Constitution, the issues of locus standi, burden of proof, quantum of compensation as stumbling blocks on the quest to foster environmental justice and governance in Nigeria. While there are emerging global trends such as the concept of holding parent companies liable for the activities of their subsidiaries on environmental matters and the growing influence of environmental NGOs and public interests’ litigations on environmental matters which had to some extent influenced Nigeria’s legal and policy framework on environmental matters. It is recommended that Nigeria should reform its laws especially Section 20 of the Constitution of Nigeria to make environmental protection justiciable in line with global trends.
